Shooting Suspect Charged

Shooting suspect, 34 year old Timothy Cunningham is now in the Knox County Detention Facility charged with 2 counts of attempted first degree murder and one count of aggravated assault.  His total bond is $125,000.  He is also wanted by Anderson County for a failure to appear on a DUI charge.

According to the Incident Report, Carrie Hutcheson Lay told detectives that she, her husband Todd Lay and her father Johnny Hutcheson were at a residence at 6121 Ball Road, Lot #40.  She said a minor physical altercation occurred between Cunningham and Todd Lay for no reason.  She said the three left the residence and as they were in the driveway, Cunningham came from behind and grabbed her hair and left shoulder and stuck a handgun to the right temple of her head and stated that he was going to kill her.  Todd Lay then stepped forward and pushed his wife out of the way and Cunningham shot him two to three times.  Cunningham then pointed the gun at Johnny Hutcheson and fired several rounds grazing the side of his head.  Carrie said she tried to call 911 on her cell phone, but the suspect’s sister, Amanda Cunningham, grabbed the phone and fled the scene.  Lay called 911 using another phone in the car.  All the victims left in a car and came into contact with a Knox County Deputy who was in the area on an unrelated incident.  He called for an ambulance.  The two shooting victims were transported to U.T. Medical Center by Rural Metro.  Hutcheson was treated and released.  Lay underwent surgery overnight.

Cunningham fled the area and was later arrested in a motel off Callahan Road by the Knoxville Police Department and KCSO.
